Originally Kirby was charged with aggravated battery, false imprisonment and first degree sexual assault contrary to secs. 940.22, 940.30 and 940.225(1) (b) and (c), Stats. Ultimately, Kirby was convicted of endangering safety by conduct regardless of life and false imprisonment (party to a crime) contrary to secs. 941.30 and 939.05, and 940.30 and 939.05, Stats. He was sentenced to consecutive terms of five and two years. Only the conviction of endangering safety by conduct regardless of life is the subject of this appeal. The issues raised by Kirby on appeal relate to alleged errors at the preliminary examination and the trial, and accordingly we deal with them under those headings.
